Insurance Program Overview 2020

The following is a brief outline of coverage provided by the policies and is not intended to change, modify, or alter any policy terms, provisions, conditions, and exclusions.

WHAT POLICIES ARE INCLUDED?

  COMMERCIAL GENERAL DIRECTORS & OFFICERS SPORT ACCIDENT
COVERAGE FOR Provides coverage for amounts up to the policy limit that an insured is legally obligated to pay as damages for bodily injury, personal injury or property damage, and associated legal costs. Provides coverage for Wrongful Acts, also known as Errors and Omission liability. Protection for the personal assets of the organization's executive committee, and the organization itself, in defense of claims (such as allegations of poor management practices) and for any compensatory damages. Provides reimbursement for medical payments related to an injury incurred while actively participating in or training for an Authorized Activity. All accident medical claims are those in excess of all other valid and collectible insurance plan(s) including provincial health plans.

WHAT IS AN AUTHORIZED PICKLEBALL SPORT ACTIVITY?

A. Game play in Canada by an Individual, Minor or Guest-- it could be structured (e.g. round robins, ladders, etc.), unstructured ("pick-up play"), at your own Organization or another PCO affiliated Organization. Individuals and Minors are also personally covered for drop-in play at a non-affiliated Court Facility (i.e. a facility that is generally owned privately or publicly and which should carry their own insurance as it is not insured under PCO policies). Play includes warm-ups, training and practice. Play must be in substantial accordance with IFP rules (sections 1-11)  . Uncontrollable rule variations (such as the placement of the NVZ line when using a badminton court) are allowed as long as such variations do not result in unsafe playing conditions.
B. Tournament play where ALL players are PCO members--may be sanctioned, non-sanctioned, club or inter-club.
C. Instructional/coaching/rating and similar sessions by Individuals for other Individuals, Minors and/or Guests.
D. Demonstrations of the sport by Individual(s) for other Individuals, Minors and/or Guests.
E. Board or committee meetings/AGM and consequential Board actions and activities. Non-alcohol only. There is no other coverage for any social events.
 

GLOSSARY OF TERMS

1 INDIVIDUAL- A person over the age of majority that holds a currently valid PCO membership when the Authorized Activity takes place.
2 MINOR - A person under the age of majority that holds a currently valid PCO membership obtained through membership in an Organization.
3 GUEST - A person that does not hold a valid PCO membership who is appropriately authorized by an Organization to participate in an Authorized Activity to a maximum of three (3) appearances. The Organization is responsible for the tracking of such.
4 VOLUNTEER - A person in a non-player role assisting with the presentation of an Authorized Activity. May or may not be a PCO Member. Includes such persons as a referee or other event volunteers.
5 INSTRUCTOR/COACH - An Individual that provides pickleball instruction, teaching, ratings or similar services on a volunteer or paid basis. Non PCO members providing such services must provide their own insurance coverage for their activities and should provide proof that such exists.
6 DIRECTOR/OFFICER - A Director and/or Officer of an Organization.Non PCO members providing such services must provide their own insurance
7 ORGANIZATION - An entity affiliated with PCO and that is an incorporated or unincorporated club or group, or, a Provincial/Territorial Sports Organization (PTSO). Where a PTSO exists, the Organization's affiliation must come through that PTSO. Affiliation requirements may differ among PTSOs, but a primary requirement is that all members of the Organization must be members of PCO and the PTSO (where one exists).
8 COURT FACILITY - A suitably safe facility used by the Organization where the Authorized Activity takes place. The "suitably safe" determination will be made by the Organization and would include, but not be limited to, considerations such as adequacy of distance between courts and walls, adequate padding of any infringing obstacles, court surface, weather conditions at the time, etc. A Certificate of Insurance is available for an Organization to provide to such Court Facility, if requested, in order to conduct an Authorized Activity. 9 INSURANCE TERMINOLOGY - WRONGFUL ACTS - Any actual or alleged error, misstatement or misleading statement by an insured. Any actual or alleged act, omission, neglect or breach of duty by an insured. See FAQ #1 for additional considerations. GENERAL AGGREGATE - the maximum amount the insurer will pay out during a policy tenure. COMPENSATORY DAMAGES -Compensatory damages refer to the sum of money the at-fault party must pay an injured party as compensation for causing some sort of injury or loss. They are awarded in civil suits wherein the negligence or wrongful conduct of one party causes another's loss.
10 RELEASE AGREEMENT WAIVER OF LIABILITY ("WAIVER”) - An electronically or manually signed Waiver must be on file at PCO or the Organization for all Individuals, Minors and Guests. For Minors, it is to be counter- signed by the Parent/Guardian. A one-time electronically signed Waiver is requested of Members when they access their profile on the PCO website. See FAQ #4 for additional information.
11 Valid PCO Membership - There is NO GRACE PERIOD with respect to renewals. Coverage commences when payment is first received from the Individual (whether it's by the club, the province or PCO). There should be some evidence kept of the payment receipt date. This covers the possible time lag from when the Individual or Minor pays, to the time when funds are received by PCO.
